Welcome to Club Kokomo Spirits. These Terms of Service ("Terms") govern your use of the website located at clubkokomospirits.com (the "Site") and the purchase of products from Club Kokomo Spirits, Inc. ("Club Kokomo," "we," "us," or "our"). By using this Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Age Requirement (21+)

Club Kokomo sells alcoholic beverages. You must be at least 21 years of age to browse, purchase, or receive shipments from this Site. By entering the Site, you affirm that you are 21 or older.

At delivery, an adult aged 21 or older with valid, government-issued photo ID must be present to sign for and accept the shipment. Deliveries cannot be left unattended. If no adult 21+ is available after multiple delivery attempts, the shipment will be returned to us and refunded net of shipping and restocking fees (see Section 6).

We reserve the right to refuse service, cancel orders, or terminate accounts if we believe an order violates applicable law or these Terms, including any age-related requirement.

2. Shipping and Delivery

We currently ship to 46 U.S. states. We do not ship to Alaska (AK), Hawaii (HI), Mississippi (MS), or Utah (UT). Shipping availability is subject to state law and may change without notice. Orders placed to a prohibited state may be canceled and refunded.

How orders are fulfilled. Club Kokomo operates under a California Type 74 Craft Distiller license, which permits us to ship up to three (3) standard 750 mL bottles of spirits per order directly to consumers within California. In-state orders that stay at or below that limit ship from our San Diego, California facility.

California orders exceeding three 750 mL bottles per order: routed to our licensed retailer of record, Liquor Geeks, for shipment in compliance with California law.
Orders shipped outside California: fulfilled through our licensed retailer of record, Liquor Geeks, which holds the appropriate retailer and shipping licenses in each destination state consistent with the three-tier distribution structure described in Section 3. You may see "Liquor Geeks" listed on your shipping notification, tracking updates, or billing statement.

Order routing, age-verification checks, and payment authorization are coordinated by our compliance-technology partner, AccelPay.

Bottle-count limits apply to standard 750 mL spirits. RTD (ready-to-drink) canned cocktails, non-alcohol merchandise, and other product formats are counted and shipped according to the routing rules above and applicable state law.

Estimated delivery times, shipping rates, and available carriers are shown at checkout. Actual transit times may vary depending on the fulfillment path, weather, carrier delays, or age-verification pickup requirements. We are not liable for delays caused by carriers, weather, or events outside our reasonable control.

Free shipping promotions (including our automatic FREESHIP200 discount) apply only when the cart subtotal meets or exceeds the stated threshold and only to eligible U.S. destinations. Shipping-restricted states remain excluded regardless of cart value.

3. Payment Processing

Payment is processed through our alcohol-compliance technology partner, AccelPay. Retail sale of alcohol occurs through licensed retailers in each destination state, per applicable three-tier distribution laws. For orders fulfilled by our retailer of record, your credit card or payment method will be charged by Liquor Geeks (the licensed retailer), not by Club Kokomo Spirits, Inc. directly. This structure is standard for direct-to-consumer alcohol shipping in the United States and is why the charge on your statement may read "Liquor Geeks" rather than "Club Kokomo."

You represent that any payment information you provide is accurate, current, and yours to use.

4. Product Availability and Pricing

We reserve the right to limit quantities, discontinue products, correct pricing or product-description errors, and refuse or cancel orders at any time, including after an order has been submitted. If we cancel an order after payment, we will refund the full amount charged.

Prices are shown in U.S. dollars and do not include applicable taxes, which are calculated at checkout based on the destination.

5. Discount Codes and Promotions

Discount codes are subject to their individual terms, expiration dates, minimum-purchase requirements, and product-scope rules. Except where noted, discount codes are:

Limited to one use per customer;
Not redeemable for cash;
Not stackable with other discount codes;
Not applicable to gift cards, prior purchases, taxes, or shipping charges unless expressly stated.

The WELCOME10 code offers 10% off a customer's first order, one use per customer, and cannot be combined with other percentage-off codes. Free shipping promotions (FREESHIP200) will stack with most discount codes above the stated cart threshold.

We reserve the right to modify or terminate any promotion at any time.

6. Returns, Refunds, and Damaged Shipments

Because of laws regulating the shipment of alcoholic beverages, we generally cannot accept returns of unopened or opened bottles once shipped. Please review your order carefully before submitting.

We will refund or replace products in the following cases:

Damaged in transit: contact info@ckspirits.com within 7 days of delivery with photos of the damaged shipment and product. We will arrange a replacement or refund.
Wrong item shipped: we will replace or refund at our option.
Undeliverable / refused delivery: if the shipment is returned to us (for example, no adult 21+ available to sign after multiple attempts, or an incorrect address supplied), we will refund the product cost less original shipping and a reasonable restocking fee.

Non-alcohol merchandise (apparel, glassware, accessories) is returnable in new, unused condition within 30 days of delivery. Buyer pays return shipping unless the item was defective or shipped in error.

7. Cancellations

You may request cancellation of an order within 24 hours of placement by emailing info@ckspirits.com. Once an order has entered the fulfillment or shipping process, we cannot guarantee cancellation. California residents may have additional cancellation rights under state law.

8. Intellectual Property

All content on the Site — including the Club Kokomo™ name, the Club Kokomo logo, product designs, packaging, photography, illustrations, copy, and software — is the property of Club Kokomo Spirits, Inc. or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, republish, download, display, post, or transmit any content from the Site for commercial purposes without our prior written permission. Personal, non-commercial browsing and sharing of Site links on social media is permitted.

9. User Submissions

If you submit reviews, comments, photos, ratings, or other content to the Site (through Judge.me, our contact forms, or otherwise), you grant Club Kokomo a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, adapt, publish, and display that content in connection with our business, including marketing. You represent that you own or have permission to submit the content and that it does not violate any third-party rights or applicable law.

We may moderate, edit, or remove user content at our discretion.

10. Acceptable Use

You agree not to:

Use the Site if you are under 21;
Purchase products for resale or for anyone under 21;
Attempt to circumvent age verification;
Interfere with the Site's operation, security, or other users' access;
Use bots, scrapers, or automated tools to collect data from the Site without our written permission;
Use the Site in violation of any applicable law.

11. Third-Party Services and Links

The Site integrates or links to third-party services, including but not limited to Shopify (e-commerce platform), AccelPay (alcohol-compliance and payment-routing technology), Liquor Geeks (licensed retailer of record), Klaviyo (email and SMS marketing), Google Analytics, Judge.me (reviews), and social media platforms. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services or content.

12. Disclaimers

The Site and all products are provided "as is" and "as available." To the maximum extent permitted by law, Club Kokomo disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Product descriptions, tasting notes, ABV, and images are provided in good faith but may contain errors or vary from actual product.

Nothing in these Terms limits any non-waivable rights you have under applicable consumer protection law.

13. Limitation of Liability

To the maximum extent permitted by law, Club Kokomo, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products, including but not limited to lost profits, lost data, or loss of goodwill, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or related to these Terms or your use of the Site shall not exceed the amount you paid to Club Kokomo in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Club Kokomo Spirits, Inc., its officers, directors, employees, and agents from any claim, damage, loss, liability, cost, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your violation of applicable law, or your infringement of any third-party right.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction there. To the extent permitted by law, you waive any right to a jury trial and any right to participate in a class action.

Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted at this URL with an updated "Last updated" date. Material changes will be highlighted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
